Case Study
Bail Condition Modified In Criminal Matter
Application Partly Allowed — Bail Condition Modified
Background
The applicant had earlier been released on regular bail by the High Court, subject to conditions. One of those conditions restrained the applicant from entering a particular district till the conclusion of trial, except for marking presence before the concerned Police Station and for attending Court. By the present application, the applicant sought modification of that condition.
Grounds Raised In The Application
- The applicant resides and earns his livelihood within the city, and the condition prevented him from doing so.
- No condition imposed by the Court had been breached by the applicant.
- The applicant undertook not to enter the territory of the concerned Police Station, where the complainant resides.
Order
Having considered the submissions and the averments in the application, the Court partly allowed the application. The condition was modified so that the applicant is restrained only from entering the territory of the concerned Police Station till the conclusion of trial, in place of the earlier, wider restriction. Rule was made absolute to that extent.
